Drug pricing transparency
Drug pricing transparency obligations are reaching into Financial and Capital Markets in ways that most compliance teams did not anticipate two years ago. The U.S. Securities and Exchange Commission's disclosure expectations around material drug pricing exposure, combined with enforcement posture from the U.S. Department of Health and Human Services Office of Inspector General on rebate arrangements, are forcing asset managers and insurers with pharmacy benefit holdings to revisit how pricing risk is characterized in public filings. Short disclosures that once passed review are now drawing comment letters.
